By downloading, accessing or playing Aether Rush (the “Game”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Game.
1. Eligibility and account
You must be legally able to accept these Terms. If local law requires a parent or guardian’s consent, they must review and accept these Terms for you. The Game creates a pseudonymous player profile for online features using an installation identifier. You are responsible for activity associated with your device and for keeping it secure.
2. License
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the Game on Apple-branded devices that you own or control, subject to Apple’s usage rules. The Game is licensed, not sold. All rights not expressly granted remain reserved.
3. Fair play and acceptable conduct
You may not cheat, automate play, exploit bugs, interfere with races or servers, reverse engineer except where law expressly permits, impersonate others, submit abusive or unlawful profile text, attack the service, or use the Game commercially without written permission. We may correct results, remove content, restrict online access, or suspend a profile when reasonably necessary to protect players and the service.
4. Virtual items
Coins, gems, fuel, cars, passes, upgrades and other virtual items are limited licenses for use inside the Game. They have no cash value, cannot be exchanged for money, and may not be transferred or sold outside features we expressly provide. Balancing, availability and presentation may change as the Game evolves. We will not knowingly remove paid entitlements without a valid operational, legal or safety reason.
5. Purchases and refunds
In-app purchases are offered and processed by Apple through the App Store. Prices and taxes appear in the purchase sheet before confirmation. Consumable items are generally not restorable after they are used. Eligible non-consumable items and active subscriptions can be restored through the Game’s Restore Purchases control. Refund requests are governed and handled by Apple under applicable App Store policies and law.
6. Auto-renewable subscriptions
If you purchase the Royal Monthly Card or another auto-renewable subscription, payment is charged to your Apple Account after confirmation. The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the current period ends. Apple may charge the renewal within 24 hours before the end of the period. You can view, change or cancel subscriptions in your Apple Account subscription settings. Deleting the Game does not cancel a subscription.
7. Online services
Online matchmaking, rankings, live races and related features depend on internet and server availability. We may maintain, update, limit or discontinue online features. We aim to preserve fair competition but do not guarantee uninterrupted connections, a particular opponent, rank, season length or result when technical failures occur.
8. Updates and changes
We may update the Game and these Terms to reflect new features, security, law or service changes. Material revisions will be identified by a new “Last updated” date and, when appropriate, an in-game or store notice. Continued use after an effective revision constitutes acceptance where permitted by law.
9. Intellectual property
The Game, including its code, art, vehicles, tracks, audio, interface and trademarks, is owned by us or our licensors and protected by applicable intellectual-property laws. You retain rights in lawful content you submit, such as a nickname, and give us a limited license to display and process it only to operate the Game.
10. Disclaimers and liability
To the fullest extent permitted by law, the Game is provided “as is” and “as available,” without implied warranties. We are not liable for indirect, incidental, special or consequential loss arising from use of the Game. Nothing in these Terms excludes consumer rights or liability that cannot legally be excluded or limited.
11. Termination
You may stop using the Game at any time. We may restrict or terminate access for a serious or repeated breach, fraud, security risk, legal requirement or discontinuation of the service. Provisions that by nature should survive termination—including ownership, payment, disclaimers and liability—will survive.
12. Apple-specific terms
These Terms are between you and us, not Apple. Apple is not responsible for the Game or its support. To the extent required by the App Store terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable license terms after your acceptance. Apple’s standard Licensed Application End User License Agreement also applies where these Terms do not provide otherwise.
